Abstract

The right to protection of health guarantees access to care and the principle of equal access complements this right by the notion of redistribution of healthcare resources. The laws in Western countries satisfy the requirements that these two principles imply. However, in practice those who are excluded from the right to care and the inequalities are increasing, owing to the very evolution of the healthcare system towards ever more technicity and lifestyles or work patterns.
