Abstract

Although the world witnessed major leaps in modern medicine, the practice of traditional medicine is still representing a historical and cultural heritage for many developing counties. In some countries, the practice of traditional medicine is widespread, and its providers are regarded healthcare providers next to the providers of modern medicine. This situation has led some to include traditional medicine into the modern healthcare system.
In this study, we have attempted to delineate the meaning of traditional medicine in light of the Kuwaiti laws and whether it is can be regarded part of the modern healthcare system. This study also seeks to determine the extent of traditional medicine practitioner’s liability. To achieve this end, we have endeavored to answer several questions related to this topic through the analysis of the general rules governing civil liability, as well as the legal rules governing the practice of modern medicine and assess whether they are relevant to traditional medicine in order to decide if a statutory amendment is required.
