Abstract

On September 6 2020, the French court of Cassation overruled, with regard to the law on filiation, the decision of the Court of Appeal of Montpellier to order the transcript of the legal notice « biological parent » on the birth certificate of a child conceived with the semen of a transgender woman, born man. Rather, the highest Court considered that denying such a transcription does not equal to a disproportionate infringment to the right to respect for private and family life due to the best interest of the child to know the truth about its conception.
